In the Matter of Eller, 331 N.C. 714 (1992)
Held:
Reversed and Remanded
The trial court erred by denying the juveniles’ motion to dismiss petitions charging them with disorderly conduct in a school where evidence that one student lunged at another with a nail and that both banged on a radiator causing a rattling noise, which prompted other students to look, was not sufficient to show that the students’ behavior constituted a “substantial interference” with the teaching of students.
