Held: Affirm in part
- G.S. 7B-911 requires the court to make findings and conclusions that support the entry of a custody order under G.S. Chapter 50, and G.S. 50-13.2(a) requires findings and conclusions that “best promote the interest and welfare of the child.” Findings of mother’s opiate use, late arrivals for and erratic behavior at visits, and father’s testing negative for drugs and having an appropriate residence and sufficient financial resources supported court’s conclusion that custody to the father was in the child’s best interests.
Held: Reverse in part and remand
- G.S. 911(c)(2) requires the court make findings that continued state intervention on behalf of the child is not necessary. Without such a finding, the court cannot terminate its jurisdiction.
