New publication question-and-answer: Jamie Markham on North Carolina Crimes

North Carolina Crimes: A Guidebook on the Elements of Crime is a resource on North Carolina substantive criminal law. Originally written for law enforcement officers, it has evolved over nearly half a century into an important reference source for sheriffs, probation officers, magistrates, prosecutors, public defenders, defense lawyers, and judges, as well as for those studying criminal law in an academic setting. 

This book attempts to cover all criminal offenses except those that are charged only rarely in the state criminal justice system.

Now in its recently released eighth edition, North Carolina Crimes incorporates statutory changes made through the 2024 session of the General Assembly and case law through January 2025. It supersedes all earlier editions and supplements. Below, faculty editor and revisor James M. Markham answers questions about putting together the newest version of this flagship School publication.

Could you describe the editing and revision process for this publication?

JM: The revision process involved looking at all the appellate cases, legislation, and new crimes enacted since the last full edition was published in 2012.

What date is this publication comprehensive and inclusive of?

JM: Cases and legislation are current through the end of 2024.

How might it differ/update, or offer supplementary information to previous editions?

JM: Since the publication of the last full edition, there have been so many developments in criminal law that are covered in the book. A few that stand out include the evolution of the law of self-defense, the constitutionality of various firearm laws, the legality of electronic sweepstakes, and many new laws applicable to sex offenders. There are also discussions of how to harmonize various crimes involving threats with a person’s First Amendment right to free speech.  Finally, this edition covers legislative changes made to combat the opioid crisis and has new entries on animal cruelty and dogfighting.

How will this publication be helpful for law enforcement officers—and in a broader sense, any person interested in or working in the criminal law space?

JM: North Carolina Crimes will help officers and others determine the appropriate charges based on the facts of a case. It also provides guidance on how the courts have interpreted those laws, including any constitutional concerns, giving practitioners greater confidence in their charging and enforcement decisions.
